These Terms & Conditions ("Terms") govern your access to and use of the Akkivinaya Sports website, online store, and related services, including the purchase of cricket bats, cricket equipment, accessories, and other sporting goods offered by us.

By accessing, browsing, creating an account on, or purchasing products through our website, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree with these Terms, please do not use our website or services.

Akkivinaya Sports was born from a genuine love for cricket and a simple belief: every player deserves equipment they can trust when they walk onto the field.

We are a cricket-focused sporting brand engaged in the sale of quality cricket equipment and accessories, with cricket bats at the heart of what we do. Our goal is to serve players at every stage of their journey—from young cricketers holding a bat for the first time to passionate club, recreational, and competitive players striving to take their game further.

Our product range may include English Willow cricket bats, Kashmir Willow cricket bats, junior and youth cricket bats, batting gloves, batting pads, cricket helmets and protective equipment, bat grips, bat covers, bat care and maintenance products, cricket balls, cricket bags, wicket-keeping equipment, cricket clothing and accessories, along with other cricket and sporting products introduced from time to time.

3. Definitions

For the purposes of these Terms & Conditions, the following words and expressions shall have the meanings set out below:

Account means a customer account created or registered on the Akkivinaya Sports Website for accessing account-related features, managing personal information, placing or reviewing Orders, and using other services made available through the Website.

Customer, User, you, or your means any individual or entity that accesses, browses, registers on, interacts with, or purchases Products through the Akkivinaya Sports Website or any other Platform operated by us.

Products means cricket bats, cricket equipment, apparel, accessories, sporting goods, and any other merchandise offered for sale by Akkivinaya Sports through the Website or Platform.

Website or Platform means the Akkivinaya Sports website, including akkivinayasports.com, and any other website, application, digital platform, or online service operated by Akkivinaya Sports through which Products, information, or services are made available.

Order means a request submitted by a Customer through the Website or Platform to purchase one or more Products from Akkivinaya Sports, subject to acceptance, availability, payment confirmation, and these Terms & Conditions.

Customised Product means any Product that has been personalised, altered, prepared, knocked-in, fitted with accessories, engraved, stickered, modified, or otherwise prepared according to a Customer's specific instructions, selections, or requirements.

Payment means any amount paid or payable by a Customer in connection with an Order, including the price of Products and, where applicable, shipping charges, taxes, duties, or other charges disclosed during checkout.

Delivery Address means the address provided by the Customer for delivery of an Order. The Customer is responsible for ensuring that the information provided is complete and accurate.

Business Day means a day on which normal business operations are conducted in India, excluding Sundays and applicable public holidays.

Third-Party Service Provider means any external service provider used by Akkivinaya Sports in connection with the Website or fulfilment of Orders, including payment gateways, courier and logistics providers, communication providers, hosting providers, and other technology or operational service providers.

4. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract under applicable Indian law to independently purchase products through our website.

If you are under 18 years of age, you may use the website or purchase products only under the supervision and with the consent of your parent or legal guardian.

By placing an order, you represent that the information you provide is accurate and that you are legally authorised to enter into the transaction.

5. Customer Accounts

Certain website features may require you to create an account or log in using a phone number and OTP.

When creating or using an account, you agree to provide accurate, current, and complete information; keep your login credentials and OTP secure; keep your contact and delivery information updated; and notify us promptly if you believe your account has been accessed without authorisation.

You are responsible for activities performed through your account to the extent permitted by applicable law. We may suspend or terminate an account where we reasonably believe it is being used fraudulently, unlawfully, or in violation of these Terms.

6. Product Information

We make reasonable efforts to provide accurate descriptions, specifications, photographs, weights, sizes, colours, willow grades, and other product information.

However, certain cricket products, particularly natural willow cricket bats, have characteristics that naturally vary from one piece to another.

Natural Variations in Cricket Bats

Cricket bats manufactured from English Willow, Kashmir Willow, or other natural wood may differ in grain count and appearance, grain spacing, wood colour and shade, minor knots or natural markings, weight, balance and pickup, handle feel, profile, edge thickness, spine height, and other natural characteristics of timber.

These natural variations do not necessarily constitute manufacturing defects. Product photographs displayed on our website are intended to represent the product as accurately as reasonably possible. Unless a listing expressly states that the customer will receive the exact bat shown, the grain pattern, shade, markings, and other natural characteristics of the bat delivered may differ from the photographs.

7. Cricket Bat Weight & Specifications

Where a cricket bat's weight is specified, the stated weight may be approximate. Actual weight can vary slightly due to natural variations in willow, moisture levels, grips, stickers, toe guards, protective sheets, anti-scuff sheets, and other fittings.

The perceived pickup or balance of a cricket bat may also differ between players even where two bats have a similar measured weight. Customers should carefully review the product specifications and contact Akkivinaya Sports before purchasing if a particular weight range, profile, pickup, grain structure, or other characteristic is important.

8. Pricing

All product prices displayed on the website are stated in Indian Rupees (INR) unless otherwise specified.

Prices may include or exclude applicable taxes depending on how they are displayed on the website. Any applicable GST, delivery charge, handling fee, or other charge will be communicated during checkout where applicable.

We reserve the right to change product prices, promotions, discounts, or offers at any time before an order is confirmed. If a product is incorrectly priced due to a technical, typographical, or system error, we may contact you before fulfilling the order and provide appropriate options in accordance with applicable law.

9. Orders & Order Acceptance

Submitting an order does not necessarily mean that we have accepted it. After receiving an order, we may send an acknowledgement or confirmation electronically.

An order may be declined or cancelled where reasonably necessary, including where the product is unavailable, there is an obvious pricing or product information error, payment has not been successfully completed, we reasonably suspect fraudulent activity, the delivery address cannot be serviced, quantity restrictions apply, or fulfilling the order would violate applicable law.

If we cancel an order after receiving a valid payment, the amount paid for the cancelled portion will be refunded in accordance with applicable law and our refund/cancellation process.

10. Payments

We may accept payments through payment methods displayed at checkout, which may include credit cards, debit cards, UPI, net banking, digital wallets, Cash on Delivery where available, and other payment methods introduced from time to time.

Online payments may be processed by third-party payment gateways or financial institutions. Akkivinaya Sports does not control the independent systems of banks, card networks, UPI providers, or payment gateways and is not responsible for interruptions attributable solely to those third-party systems, subject always to your rights under applicable law.

11. Shipping & Delivery

We will make reasonable efforts to dispatch and deliver orders within the estimated timelines communicated on our website or during checkout. Delivery times are estimates unless expressly guaranteed.

Shipping is currently free across India for website orders unless a product page, checkout screen, or special offer states otherwise. International delivery, where available, may involve additional shipping charges, customs duties, taxes, or import requirements payable by the recipient.

Delivery may be affected by courier or logistics delays, weather conditions, natural disasters, public holidays, strikes or transportation disruptions, incorrect or incomplete addresses, remote delivery locations, government restrictions, or other circumstances beyond our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and contact information. Detailed shipping rules, charges, serviceable locations, and delivery procedures may be provided separately in our Shipping Policy.

12. Inspection of Products on Delivery

Customers should inspect their package and product as soon as reasonably possible after delivery. If a product arrives damaged, incorrect, incomplete, or with an apparent manufacturing defect, please contact us promptly within the period specified in our return/refund process.

For damage claims, we may reasonably request photographs or videos showing the external shipping package, shipping label, internal packaging, product received, and the claimed damage or defect.

We strongly recommend recording an unboxing video for high-value cricket bats. However, an unboxing video requirement will not limit any rights that cannot legally be excluded under applicable consumer law.

13. Cricket Bat Preparation & Knocking-In

Cricket bats made from natural willow generally require appropriate preparation before match or net use. Depending upon the product and manufacturer recommendations, preparation may include oiling, knocking-in, gradual preparation using an old cricket ball, application of an anti-scuff sheet, toe protection, and other appropriate bat-care procedures.

Customers should follow the manufacturer's instructions and/or guidance supplied with the product. Using a bat before adequate preparation may increase the likelihood of surface cracking, edge damage, toe damage, or other deterioration.

Normal wear resulting from cricket-ball impact or ordinary use should not automatically be regarded as a manufacturing defect.

14. Knocking-In & Customisation Services

Where Akkivinaya Sports offers knocking-in, anti-scuff application, grip replacement, toe guard installation, engraving, personalised stickers, or another customisation service, the service may alter the product from its original condition.

Customers should carefully verify all customisation instructions before submitting an order. Except where required by applicable law or where the product is defective, damaged, incorrectly supplied, or the service was incorrectly performed, a product customised specifically at the customer's request may not be eligible for return or exchange merely because the customer changes their mind.

Specific terms applicable to customisation services may also be displayed on the relevant product or service page.

15. Returns, Exchanges & Refunds

Returns, exchanges, cancellations, and refunds are governed by our return, refund, and cancellation process, which forms part of these Terms.

Eligibility may depend on matters such as the reason for the return, product condition, whether the product has been used, whether original packaging, tags, or accessories are available, whether the product was customised, and whether the product has a manufacturing defect or was damaged in transit.

Nothing in these Terms is intended to remove or restrict any statutory rights available to consumers under applicable Indian law.

16. Cricket Bat Warranty & Damage

Where a manufacturer provides a warranty, warranty claims will be handled in accordance with the relevant manufacturer's warranty terms and applicable law.

A warranty does not ordinarily cover damage arising solely from normal wear and tear, improper storage, excessive moisture or extreme dryness, failure to prepare or maintain the bat appropriately, use against unsuitable balls, yorker or toe impact damage, edge impact caused by normal play, deliberate misuse, accidental damage, alteration or unauthorised repair, or failure to follow manufacturer care instructions.

Surface cracks may occur naturally in willow bats during use and do not necessarily indicate structural failure or a manufacturing defect. Nothing in this section excludes liability or warranty obligations that cannot lawfully be excluded.

17. Product Availability

All products are subject to availability. Cricket bats, particularly specific willow grades, weights, profiles, grain preferences, and limited-edition models, may have limited stock.

Adding a product to your shopping cart does not reserve that product unless expressly stated otherwise. If an ordered product becomes unavailable after payment, we will contact you and provide an appropriate remedy, which may include a refund or, with your agreement, an alternative product.

18. Promotions, Coupons & Discounts

We may periodically provide discount codes, promotional offers, bundles, loyalty benefits, or other promotions.

Unless otherwise stated, promotions cannot be exchanged for cash, may have an expiry date, may require a minimum purchase, may exclude certain products, may not be combinable, and may be cancelled if misused or used fraudulently. Any additional terms displayed with a promotion will also apply.

19. Acceptable Use of the Website

You agree not to use the website for unlawful or fraudulent purposes; attempt to gain unauthorised access to our website, servers, accounts, or systems; introduce viruses, malware, malicious code, or other harmful technologies; interfere with the website's operation or security; use automated systems to scrape or extract website content without permission; impersonate another person; submit false or misleading information; attempt fraudulent payments or chargebacks; or use website content for unauthorised commercial purposes.

We may restrict access where we reasonably believe these Terms have been violated.

20. Intellectual Property Rights

Unless otherwise stated, the website and its original content, including the Akkivinaya Sports name, logos, branding, graphics, photographs, product descriptions, videos, website design, and other materials created or owned by us, are owned by or licensed to Akkivinaya Sports and are protected by applicable intellectual property laws.

Third-party brand names, trademarks, product photographs, and logos remain the property of their respective owners. You may use the website for personal and lawful shopping purposes.

You must not copy, reproduce, republish, distribute, modify, sell, commercially exploit, or create derivative works from our proprietary website content without our prior written permission, except where permitted by law.

21. Third-Party Brands

Akkivinaya Sports may sell products manufactured by third-party cricket and sporting brands. All trademarks, logos, product names, and other intellectual property associated with those brands belong to their respective owners.

The availability of a third-party product through Akkivinaya Sports does not transfer any intellectual property rights in that brand to the customer.

22. Product Reviews & User Content

Where the website allows customers to submit ratings, reviews, photographs, comments, or other content, you agree that your submission must be based on genuine experience where represented as such; not contain unlawful, defamatory, threatening, abusive, or obscene material; not infringe another person's intellectual property or privacy rights; not contain malicious software or misleading links; and not constitute fraudulent or deceptive advertising.

Subject to applicable law, we may moderate or remove content that violates these requirements.

23. Privacy & Personal Data

We may collect and process personal information necessary to operate our website, fulfil orders, process payments, provide customer service, prevent fraud, and comply with legal obligations.

Our handling of personal information is governed by our Privacy Policy, which should be read together with these Terms.

24. Communications

When you place an order or create an account, you agree that we may send transactional or service-related communications regarding order confirmations, payment status, shipping and delivery updates, returns and refunds, account security, and customer-support requests.

Where required by applicable law, promotional communications by email, SMS, WhatsApp, or other channels will be sent based on the applicable consent requirements and opt-out rights.

25. Third-Party Services & Links

Our website may use or link to third-party services such as payment gateways, courier companies, logistics providers, social-media platforms, analytics services, and other external websites or service providers.

Third-party websites and services may operate under their own terms and privacy policies. To the extent permitted by law, Akkivinaya Sports is not responsible for independent third-party content or services outside our control.

26. Website Availability & Security

We take reasonable measures to maintain the availability and security of our website. However, we do not guarantee uninterrupted or error-free access at all times.

The website may occasionally be unavailable due to maintenance, technical issues, security updates, hosting failures, or circumstances beyond our reasonable control. You are responsible for maintaining appropriate security on the device and internet connection you use to access our website.

27. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited under applicable law.

Subject to the above, Akkivinaya Sports will not be responsible for indirect or consequential losses arising from use of the website or products where such losses were not reasonably foreseeable or are attributable to misuse of the product.

Customers are responsible for selecting cricket equipment appropriate for their intended use, skill level, size, playing conditions, and applicable competition requirements. Cricket is a physical sport involving inherent risks. Protective cricket equipment can reduce certain risks but cannot eliminate all possibility of injury.

28. Force Majeure

Akkivinaya Sports will not be responsible for delays or failure to perform an obligation where performance is prevented by circumstances beyond our reasonable control, subject to applicable law.

Such circumstances may include natural disasters, floods, fires, epidemics, pandemics, strikes, transportation disruptions, wars, civil disturbances, government restrictions, telecommunications failures, internet outages, and major logistics disruptions. We will make reasonable efforts to resume affected operations when practicable.

29. Indemnity

To the extent permitted by applicable law, you agree to indemnify Akkivinaya Sports against losses, liabilities, or reasonable costs resulting directly from your unlawful use of the website, fraudulent activity, infringement of third-party rights, or material violation of these Terms.

This provision does not limit any statutory consumer rights.

30. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India. Nothing in these Terms is intended to restrict any mandatory rights or remedies available to consumers under applicable Indian law.

31. Jurisdiction & Dispute Resolution

We encourage customers to contact Akkivinaya Sports first if any concern or dispute arises so that we can attempt to resolve the matter promptly.

Subject to applicable consumer protection laws and any mandatory jurisdiction available to consumers, disputes arising from these Terms or use of the website shall be subject to the jurisdiction of the competent courts at Kolkata, West Bengal, India.

Nothing in this clause prevents a consumer from exercising any right to approach an appropriate consumer commission, court, or other authority where such right is provided by applicable law.

32. Changes to These Terms

We may update these Terms periodically to reflect changes to our products, website, business operations, or applicable legal requirements. The latest version will be published on this page together with an updated "Last Updated" date.

Your continued use of the website after revised Terms become effective constitutes acceptance of those Terms to the extent permitted by applicable law.

33. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable by a competent authority, that provision will be treated as severed to the extent necessary, while the remaining provisions will continue in effect.

34. No Waiver

If Akkivinaya Sports does not immediately enforce a provision of these Terms, that does not constitute a waiver of our right to enforce that provision or any other provision later.

These Terms, together with our applicable Privacy Policy, Shipping Policy, Return, Refund & Cancellation Policy, Warranty Policy, and any product-specific terms displayed on the website, constitute the terms governing your use of our website and purchases from Akkivinaya Sports, subject to applicable law.

Where product-specific terms conflict with these general Terms, the product-specific terms may apply to that product to the extent permitted by law.
